is very prominent in Spain and very much in evidence in Benidorm. There is much ignorance still amongst the gay
community who are not given the information needed to make informed choices, often leaving people to make
choices based on myths rather than hard fact.
The issuing of free condoms is rare in most bars and clubs as there is no central funding from the health authorities
for such services. If you have access to free condoms please bring them with you and offer them to bar owners.

If you bring condom packs with you please leave them in your favourite bar so these may be passed onto customers.
IT IS NOT ILLEGAL TO BE GAY IN SPAIN
Homosexuality has been decriminalised in Spain since 1822. The legal age of consent for heterosexual and
homosexual persons has been13 since 1999 prior to this it was 12. Spain also gives rights to trans gendered
persons by allowing gender reassignment to be included in birth registers.
Although the legal age of consent is low their is an offence protecting all age groups. "Violating a persons sexual
liberty by sexual contact without consent or even with consent if this consent is obtained by taking advantage of a
relationship of superiority which reduces a persons sexual liberty."
For example whilst quite legal for a person of 45 years of age to have sex with a person of 14 years of age who
consents, it could be deemed that the maturity of a 45 year old could have influenced a person of 14 to have sex by
consent. Therefore making it illegal and happily protecting the vulnerable.

SEX IN PRIVATE PREMISES AND IN PUBLIC SPACES IN SPAIN
It is not illegal to have sex on private premises such as saunas in Benidorm if all concerned parties are consenting
and of legal age.
It is also not illegal to have sex in open spaces such as the beaches provided that.
1. All persons are consenting and of legal age.
2. It is not in the presence of minors or those with learning disabilities.
There is an offence of exhibitionism and sexual provocation but for this to happen there would have to be
minors or mentally disabled persons present and you would have to provoke others or yourself to be sexually
excited. Both these situations need to exist one on their own would not be an offence.
Benidorm police can ask you to get dressed, but you can refuse without causing an offence. Police may tell you
that you can be arrested for public scandal but they cannot as this law does not exist anymore. There may be
local bylaws in existence but these are not legal if they do not conform to the constitution.
You may also be naked and have sex in you own homes open spaces such as terraces and balconies without

NUDITY IN PUBLIC PLACES IS NOT ILLEGAL IN SPAIN
It s fundamental right according to the constitution to be nude in any public place such as parks, beaches, lakes
and rivers. It is not illegal in fact to be naked anywhere in Spain, according to the constitution, however pubic
acceptance would not take kindly to your bank manager being naked at work for example.
The constitution clearly states that "one has the right to one´s own image and clothing or absence
thereof."
It is interesting to note that the many nudist beaches set aside for the naturist in Spain are illegal in themselves.
This is because by setting aside these authorised areas it indicates that other areas of a beach are where clothes
must be worn, which in itself is untrue and unlawful as you may be naked in any open space anywhere in Spain.
So enjoy the freedom only found in this fabulous country to be naked as and where you wish in open spaces
